DARS Contracts Transferring to HHSC or TWC


On September 1, 2016, the Department of Assistive and Rehabilitative Services (DARS) will be abolished and DARS' programs will transfer to the Health and Human Services Commission (HHSC) or the Texas Workforce Commission (TWC).

DARS contracts utilized by programs transferring to TWC will be transferred pursuant to law to TWC. DARS contracts utilized by programs transferring to HHSC will be transferred pursuant to law to HHSC. Vendors do not have to take any steps to ensure that this transfer takes place. All terms and conditions of the contracts will remain in effect.

As needed, DARS and HHSC will procure services to ensure that each agency has access to the goods and services it needs to support the programs transferring to each respective agency.

Procurement solicitations are posted on the Electronic State Business Daily (ESBD). Vendors may look for solicitations posted by state agencies on the ESBD. Check your contract to determine whether it is expiring between now and February 28, 2017, and whether there are renewal options remaining.  If there are no renewal options, you will need to respond to an open solicitation for the services you want to provide. If you do not see a solicitation for the services you provide, contact your contract manager or other program contact to ask if a solicitation is planned for those services. Then keep an eye out on the ESBD for opportunities.

If your contract has remaining renewal options and DARS intends to exercise one of the remaining options, you will be contacted by your assigned contract manager about the renewal.

The Texas Workforce Commission Sunset bill (Senate Bill 208) directs the transfer of the following DARS programs to TWC on September 1, 2016:

  • Vocational Rehabilitation programs, including the Criss Cole Rehabilitation Center;
  • Business Enterprises of Texas; and
  • Independent Living Services for Older Individuals who are Blind (ILS-OIB)

House Bill 2463 and Senate Bill 200 direct the transfer of the following DARS programs to HHSC by September 1, 2016:

  • Autism program;
  • Blind Children's Vocational Discovery and Development Program;
  • Blindness Education, Screening, and Treatment program;
  • Comprehensive Rehabilitation Services program;
  • Disability Determination Services;
  • Early Childhood Intervention Services;
  • Independent Living Services (ILS) programs, except the ILS-OIB program; and
  • Office for Deaf and Hard of Hearing Services

In addition, House Bill 2463 requires DARS to outsource the ILS programs to Centers for Independent Living on September 1, 2016. Therefore, certain DARS contracts which only support ILS programs, including ILS-OIB, may not be renewed or procured again by either agency.
